Terms of Service

1. Acceptance of Terms

By accessing or using the Hia mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

Hia is a WhatsApp Business messaging inbox application that allows users to manage business conversations, collaborate with team members, and organize contacts. The Service integrates with the WhatsApp Business API through Kapso to send and receive messages.

3. User Accounts

3.1 Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account at hi@tryhia.com.

3.3 Account Termination

You may delete your account at any time through the app settings (Settings → Delete Account). We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Conduct

You agree not to:

Violate any applicable laws or regulations
Send spam, unsolicited messages, or engage in harassment
Impersonate any person or entity
Upload or transmit viruses or malicious code
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to any systems
Use the Service for any illegal or unauthorized purpose
Violate WhatsApp's Terms of Service or Business Policy
Collect or harvest user data without consent

5. WhatsApp Business API Usage

Use of WhatsApp messaging features through the Service is subject to:

You are responsible for ensuring your use of WhatsApp messaging complies with all applicable WhatsApp policies, including obtaining necessary consents from message recipients and adhering to message template guidelines.

6. Intellectual Property

6.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by Hia and are protected by international copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of content you create within the Service. By using the Service, you grant us a license to use, store, and process your content to provide our services.

7. Third-Party Services

The Service integrates with third-party services including:

Supabase for authentication and data storage
Kapso for WhatsApp Business API
PostHog for privacy-friendly product analytics
Expo for app distribution

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Our total liability shall not exceed the amounts you have paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Hia and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or your violation of these Terms.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hia operates, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hia regarding the Service and supersede any prior agreements.
